Damage Recovery for Wrongful Death

If you were the survivor of a deceased individual, and the cause of his/her death was another entity, you may claim for damage recovery. Florida Statutes Sections 768.16-768.26 provides the legal directives regarding wrongful death claims in the state. As per Florida law (Section 768.18), the spouse, children and parents of the decedent are within this category. Subsection 3: The minor children may recover for the loss of parental companionship, instruction and guidance. If there is no surviving spouse, all children may claim the recovery of these damages.

Subsection 4: In case of the death of a minor child, each parent may recover for mental pain and suffering. This is also possible if the child is an adult only when there are no other survivors.

Subsection 5: The survivor who paid for the medical or funeral expenses may recover these as part of the claim.

Note: There is a separate sub-section specifying the damage recovery possible for the personal representative of the decedent’s estate.
